DC Comics Sues Soccer Club Over Batman-like Logo

DC Comics has created a legal dispute with Spanish soccer club La Liga club Valencia over their logo, which just happens to be a bat. Take a look at their recently revamped mark:
Ok, I guess I can see their point. the new Valencia image looks remarkably like Batman Beyond. However, the question really lies in who was here first. Take a look at this previously trademarked seal by the club.
Valencia has been using bats in their logos for decades before Bob Kane and Bill Finger had that special twinkle in their eyes. This comes from Spanish website plazadeportiva.com:
"The Valencia CF, founded in 1919, looks at his bat emblem on the coat of the City of Valencia. In fact, in its early years, the club had to shield the city with some variation.A few years later, at the beginning of the 20s of last century, and began using the current, which has undergone very little change at this time."
And according to Yahoo News:
"…the image of a bat has been commonly used in Spanish heraldry since the 13th century…"
So, does DC have a case here? The updated logo is similar, but considering how old this tradition is, I’m not sure the publisher has a leg to stand on.
